Welcome to Casa Nieto Property Management.
These Terms & Conditions apply to services provided by Silvia Nieto trading as Casa Nieto Property Management (“Casa Nieto”, “we”, “us” or “our”).
By accepting a quotation, instructing us to proceed with work or otherwise engaging our services, you agree to these Terms & Conditions.
If you do not agree to these Terms & Conditions, please let us know before accepting a quotation or instructing us to proceed with any work.
We may update these Terms & Conditions from time to time. The version that applies to your work will normally be the version in place when you accept the relevant quotation, unless a later change is agreed with you. The “Last updated”date at the top of this page will show when these Terms were most recently
revised.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
1. Quotes & Acceptance
Our quotation sets out the work and services included in the agreed price.
Only work specifically included in the quotation, written scope of work or subsequently agreed is included.
Unless otherwise stated, quotations are based on the information and property conditions reasonably available to us at the time they are prepared.
Any measurements, quantities, timings or material estimates given before work begins are approximate unless expressly stated otherwise.
Additional or different work requested after acceptance may result in additional charges.
By accepting a quotation, the client accepts these Terms & Conditions.
2. DIY, General Maintenance, Coordination & Property Management
DIY and general maintenance services are carried out directly by Silvia Nieto on behalf of Casa Nieto Property Management.
Property management and coordination services are also provided by Silvia Nieto unless otherwise stated.
These services are not necessarily equivalent to specialist trade installations.
The nature, durability and expected finish of DIY-style products and methods may differ from specialist or traditional installation systems.
Where a client chooses a product, material or method after an alternative has been discussed or recommended, Casa Nieto is not responsible for differences in durability, appearance or performance resulting from that choice.
Casa Nieto will carry out the work it undertakes with reasonable care and skill.
3. Specialist & Subcontracted Work
Casa Nieto may engage suitably experienced or qualified tradespeople and subcontractors to carry out specialist elements of a project, including electrical, plumbing, building or other specialist work.
Where Casa Nieto provides the quotation to the client and contracts directly with the client for the work, the client's contract remains with Casa Nieto and these Terms & Conditions continue to apply.
Casa Nieto may select and manage subcontractors as part of providing the agreed service.
Specialist work may also be subject to applicable regulations, certifications, manufacturer requirements or warranties relevant to that particular trade or product.
Where certification or other documentation forms part of the agreed specialist work, this will be provided where applicable.
4. Scope of Work
The quotation defines the agreed scope of work.
Work that is visible at the property but not specifically included in the quotation is not automatically included.
Unless specifically stated otherwise, the price does not include:
-
rectification of unrelated pre-existing defects;
-
repairs to areas outside the agreed scope;
-
concealed defects or damage that could not reasonably be identified beforehand;
-
additional preparation or making good not specified in the quotation;
-
additional finishing or decorative work; or
-
work requested after the original scope has been agreed.
Where additional work becomes necessary or is requested, we will normally discuss this with the client before proceeding and agree any additional cost where reasonably practicable.
5. Existing Property Conditions
Maintenance and decorating work is frequently carried out on existing walls, ceilings, floors, fixtures, fittings and other surfaces.
Unless preparation or repair is specifically included in the quotation, Casa Nieto is not agreeing to correct every pre-existing imperfection.
Existing conditions may include:
-
uneven or out-of-square walls;
-
cracks, movement or settlement;
-
damaged or poorly prepared surfaces;
-
previous repairs;
-
loose or failing paint or plaster;
-
damp or moisture;
-
existing silicone, sealant or adhesives;
-
uneven worktops, floors or ceilings; and
-
fixtures or fittings that cannot reasonably be removed.
These existing conditions may affect the appearance, durability or method of carrying out new work.
Where a previously unidentified condition materially affects the work, we will endeavour to inform the client and discuss reasonable options.
6. Materials & Products
Materials may be:
-
supplied by Casa Nieto;
-
supplied by the client;
-
selected by the client and purchased by Casa Nieto; or
-
recommended by Casa Nieto and approved by the client.
Where a product is selected or supplied by the client, the client remains responsible for their choice of product, including its appearance, colour, design and manufacturer-stated characteristics.
Casa Nieto is not responsible for a defect inherent in a client-supplied or client-selected product, or for a product failing to perform as represented by its manufacturer, provided it has been installed or used with reasonable care and skill.
If we become aware that a client-selected product appears clearly unsuitable for the proposed use, we will endeavour to raise this before proceeding.
Natural materials, paints, finishes and manufactured products may vary slightly in colour, texture, dimensions or appearance between samples, batches or previous installations.
7. Appearance & Finishing
Maintenance and repair work often requires new materials to be adapted to existing surfaces and fittings.
Minor variations in cut lines, alignment, joints, texture, colour or finish may occur, particularly where surfaces are uneven or materials require hand cutting.
Such variations do not automatically mean that the work is defective.
Where a particular finish, tolerance or appearance is especially important, the client should raise this before work begins so that it can be included in the agreed scope where appropriate.
Silicone, caulking, trim, edging, making good, painting or other finishing work is only included where stated in the quotation.
8. Changes & Decisions During the Work
Unexpected circumstances may require practical decisions while work is underway.
Where available options are discussed with the client and the client approves a particular method, position, cut, fitting, product or practical solution, we may proceed on that basis.
Client approval does not remove Casa Nieto's obligation to exercise reasonable care and skill. However, the use of an agreed approach does not in itself make the work defective simply because another method could also have been used.
Photographs, emails, WhatsApp messages and other communications may be retained as a record of property conditions, instructions, changes and approvals.
Changes to the agreed scope may result in additional charges.
9. Access & Client Responsibilities
The client must provide reasonable access to the property at the agreed time and ensure that the working area is reasonably accessible.
Unless otherwise agreed, the client is responsible for:
-
removing particularly valuable, fragile or personal items from the working area;
-
notifying us of known hazards or defects;
-
telling us about concealed cables, pipes or other services where known;
-
obtaining any necessary landlord, freeholder or other permissions; and
-
providing accurate information relevant to the work.
Additional time or costs caused by restricted access, undisclosed conditions or circumstances outside our reasonable control may be chargeable.
10. Timescales & Delays
Any proposed start date, completion date or duration is an estimate unless expressly agreed in writing as a fixed deadline.
Work may be affected by matters such as:
-
drying or curing times;
-
additional defects discovered during the work;
-
availability or delivery of materials;
-
subcontractor availability;
-
weather;
-
access to the property; or
-
circumstances outside our reasonable control.
We will endeavour to keep the client informed of material changes to the expected schedule.
11. Prices, Materials & Payment
The quotation will set out the agreed price and payment arrangements.
Materials may be charged as:
-
a fixed materials price;
-
actual cost supported by receipts; or
-
another basis agreed with the client.
Deposits or advance payments may be required before work begins or materials are purchased.
Payment is due in accordance with the terms stated on the quotation or invoice.
Additional work requested or approved by the client may be charged separately.
12. Completion & Workmanship Concerns
Clients are encouraged to inspect completed work as soon as reasonably practicable.
Any visible concern about workmanship should be reported promptly, preferably with photographs, so that we have a reasonable opportunity to inspect the issue.
For general maintenance and DIY-type work, we ask clients to report apparent workmanship issues as soon as possible after completion and preferably within 15 days.
This 15-day period is intended to allow straightforward issues to be identified and dealt with promptly. It does not limit the client's statutory rights or mean that Casa Nieto can never be responsible for an issue discovered later.
Where a concern may relate to work carried out by Casa Nieto or on our behalf, we should normally be given a reasonable opportunity to assess the issue and, where appropriate, rectify the work before another contractor removes, replaces or substantially alters it.
If the work is altered before we have had a reasonable opportunity to inspect it, this may affect our ability to establish the cause of the problem or provide an appropriate remedy.
13. Damage or Changes After Completion
Casa Nieto is not responsible for deterioration or damage caused after completion by circumstances outside our reasonable control, including:
-
accidental or deliberate damage;
-
misuse;
-
alterations by the client or another person;
-
failure of the underlying surface or structure;
-
water ingress, damp or excessive moisture;
-
excessive heat;
-
movement or settlement;
-
failure of a product or its original adhesive or fixing system;
-
failure to follow relevant manufacturer instructions; or
-
normal wear and tear.
This does not apply where the relevant problem was caused by Casa Nieto failing to exercise reasonable care and skill.
14. Complaints & Resolution
If you are unhappy with any aspect of our service, please contact us as soon as possible at casanietopm@gmail.com.
We will normally ask for photographs or arrange an inspection where appropriate.
Where a genuine workmanship issue is identified, the appropriate solution will depend on the circumstances and may include rectification, repeat performance, a price reduction or another reasonable remedy.
Where Casa Nieto offers a refund, repair or other gesture expressly as goodwill, this does not in itself constitute an admission of liability.
15. Cancellation Rights
Consumer cancellation rights may apply to certain contracts entered into online, by telephone, by email or away from our business premises.
Where applicable, consumers may have a legal right to cancel within 14 days.
If the client asks Casa Nieto to begin providing services during an applicable cancellation period, we may require express confirmation that they wish the service to begin before that period has expired.
Where permitted by law, the client may be required to pay for services properly supplied before cancellation.
Once any applicable statutory cancellation period has expired, the following cancellation notice periods apply:

Small works and DIY appointments (scheduled for less than 6 hours): cancellations made with less than 48 hours' notice may result in all or part of the booking deposit being retained.

Larger works (scheduled for 6 hours or more, or over multiple days): cancellations made with less than 7 days' notice may result in all or part of the booking deposit being retained.
Any amount retained from the booking deposit will be limited to the reasonable losses resulting from the cancellation, including reserved working time that Casa Nieto Property Management has been unable to reasonably rebook. Where cancelled working time can reasonably be rebooked, this will be taken into account when determining the amount retained.
Materials purchased specifically for the client's work will be subject to refund where they can reasonably be returned or reused, less any non-recoverable costs incurred.
Nothing in these Terms & Conditions affects any statutory cancellation rights.
16. Liability & Statutory Rights
Casa Nieto will provide its services with reasonable care and skill.
Nothing in these Terms & Conditions excludes or restricts liability where doing so would be unlawful or removes any statutory rights available to a consumer.
Casa Nieto is not responsible for loss or damage caused solely by matters outside our reasonable control, pre-existing property conditions, client actions, product defects for which we are not responsible, or the actions of independent third parties outside the services Casa Nieto has contracted to provide.
17. Photographs & Records
We may take photographs before, during and after work for purposes including:
-
recording existing property conditions;
-
documenting work undertaken;
-
recording instructions or approvals; and
-
resolving subsequent queries or complaints.
Photographs will not be used publicly for marketing purposes without appropriate permission where the client or property could reasonably be identified.
18. Governing Law
These Terms & Conditions and contracts with Casa Nieto are governed by the laws of England and Wales.
Nothing in this clause removes any statutory right a consumer may have regarding where legal proceedings may be brought.
